Representation Summary:

Biodiversity Net Gain

Section 11 of the SPD deals with Biodiversity Net Gain. The section refers to the Environment Bill. The Environment Act received Royal Assent on the 9th November 2021. A number of its provisions will be the subject of secondary legislation, including the provisions for biodiversity net gain. This section of the SPD needs to be updated to reflect the updated position following publication of the Environment Act. In making amendments to this section the Council should also review the wording of paragraph 11.6 as the current wording is not clear.

Question 15

Representation ID: 8329

Received: 13/12/2021

Respondent: Davidsons Developments Limited

Agent: Pegasus Group

Representation Summary:

For larger scale development proposals, the range of section 106 requests can be extensive and can in certain circumstances raise issues of viability. It can then be a matter for the local planning authority and County Council to reach agreement on the priorities for contributions.

It is considered that a similar approach to that adopted by Melton Borough Council in prioritising contributions could be considered in the SPD to provide clarity in circumstances where contributions may need to be prioritised.
